This will not effect a custody case at all. This has nothing to do with the children. But on the other side, yes you can sue for alimony.

One would think that adultry does not have any bearing on a child custody case however the man I am now with lost his children because of his relationship with me. It was deemed by a court appointed psychologist, who was to determine custody and a requested move away by the mother, that since the father was not honest about his relationship with me to his wife or children that they should be moved away from him. He was said to be a very involved, loving and fit parent but since he did not disclose our relationship to everyone truthfully, he lost his children.
