How does child custody work in Texas?

I love dooneys asked:

i have two children by the same man and was never married. he was suppose to be paying childcare for them but stopped in march of this year so i filed for child support at the child support meeting he says he wants custody of the kids. he has never lived with the kids, they have never spent the night with him, he does not call at all. he use to see them when i took them over his mothers house(he lives with mother) b/c i had to work but he does not even do that anymore. he never has even took them to the doctor. all he really did was pay daycare he did not really get involved in their life. is there a chance he could get custody???what should i do??? btw my son is 4 and my daughter is 2. thanks in advance!

    Yes, there is always a chance. Check to see if there are any advocacy organizations near you. Call your local Department of Human Services and explain the situation. If there are any organizations, they will know. Best to you and your children.

    How does it work? WORK? IT DOESN’T WORK!!!! You can’t give them away. I know. I’ve tried. Sure, you’ll get custody. Why should you be any different from the rest of us?
